Distance Selling Agreement

1. Parties to the Agreement

This Distance Selling Agreement ("Agreement") is electronically executed between the user ("Buyer") subscribing to services via the Bitig platform and Bitig administration ("Seller"), establishing the legally binding terms for digital service procurement.

2. Subject Matter

The subject of this Agreement is to regulate the rights and mutual obligations of the parties pursuant to the Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts, concerning the electronic purchase and instantaneous performance of the social media digital archiving subscription ("Service").

3. Financial Terms and Secure Payment

The applicable service fees are clearly presented on the Platform's pricing interface. The Buyer consents to the recurring (monthly or annual) charges corresponding to their selected subscription tier. All financial transactions are processed securely via our BRSA-licensed payment gateway partner (e.g., Creem) utilizing PCI-DSS compliant encryption.

4. Instantaneous Performance and Delivery

Upon authorization of the payment, the digital Service is activated and rendered immediately, granting the Buyer instantaneous access to the automated archiving infrastructure. Given the intangible and immediate nature of the digital Service, traditional delivery or shipping mechanisms do not apply.

5. Exception to the Right of Withdrawal

Pursuant to Article 15(1)(ğ) of the Regulation on Distance Contracts, "contracts concerning services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer" are strictly exempt from the statutory right of withdrawal. Consequently, the Buyer acknowledges that the right of withdrawal is waived upon activation. However, subscriptions may be unilaterally cancelled at any time to prevent future billing.
